Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and AWC-DIRECT LLC ("NomadHearts", "we", "us"), the operator of the NomadHearts website and mobile app (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Please read section 20 carefully. It requires most disputes to be resolved by individual arbitration and waives your right to a jury trial and to participate in class actions. You may opt out of arbitration within 30 days of first accepting these Terms.

1. Who may use NomadHearts

You may use the Service only if you:

NomadHearts is a service for adults. We do not knowingly allow minors on the platform, and accounts believed to belong to someone under 18 are removed.

You keep ownership of the photos, text, messages, listings, posts, and other material you create ("Your Content"). By posting it, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for display, and distribute Your Content solely in order to operate and provide the Service. This licence ends when you delete the content or your account, except where the content has already been shared with others, or where we must keep a copy for legal, safety, or backup purposes.

You confirm that you own Your Content or have the rights to post it, and that it does not infringe anyone else's rights. We may remove content that breaks these Terms or the Community Guidelines.

5. Other members' content

Profiles, posts, listings, ratings, and messages from other members are their responsibility, not ours. We do not verify them and we do not endorse them. Anything you read on the Service you use at your own risk, including claims about someone's identity, skills, vehicle, goods, or intentions.

6. Our content and licence to you

The Service itself, our software, branding, and design belong to us or our licensors. We grant you a personal, revocable, non-transferable, non-exclusive licence to use the app for your own, non-commercial use in accordance with these Terms. You may not copy, modify, distribute, or create derivative works from the Service.

7. Reporting, moderation and enforcement

You can block a member and report a profile, message, post, or listing from inside the app, or write to info@nomadhearts.online. We review reports and may remove content, limit features, suspend, or permanently close accounts. We may act without prior notice when there is a risk of harm. We do not pre-screen content, and we are not obliged to monitor the Service, but we may do so.

8. No background checks

We do not run criminal background checks or verify the identity of members. Our rules ask members to be truthful, but we cannot guarantee that anyone is who they claim to be. A badge, a rating, or a complete-looking profile is not a safety guarantee.

9. Meeting people in person

NomadHearts is built for meeting people on the road: dates, campfires, meetups, convoys, repairs, and trades. Meeting anyone you do not know carries risk, and remote places carry more of it. You are solely responsible for your interactions with other members. Please read our Safety Tips before you meet someone. We are not responsible for the conduct of any member, online or offline.

10. Location features

Route matching, the Nomad Map, distance filters, and friend location sharing rely on location data you provide. Strangers only ever see an approximate area of about ten miles across, which you can switch off. Your precise position is shared only with friends you have individually approved, and you can switch that off at any time. Do not rely on the Service for navigation or in an emergency; positions may be inaccurate, delayed, or unavailable. Details are in the Privacy Policy.

11. Handy Nomads

Handy Nomads lets members offer or request practical help, as a favour or for payment. Any agreement is strictly between the members involved. NomadHearts is not a party to it, does not employ or supervise anyone, does not handle payment, and gives no warranty as to quality, safety, licensing, insurance, or the outcome of any work.

If you offer help, you are responsible for complying with the law where you are, including any licence, permit, insurance, and tax obligations. Do not offer work you are not competent to do, and do not misrepresent qualifications. Work involving gas, high-voltage systems, brakes, or structural changes can be dangerous and may be regulated.

12. Marketplace

The Marketplace lets members list items for sale. Sales are directly between members. NomadHearts does not sell the items, does not hold funds, does not process payments, and does not inspect goods. We are not a party to any sale and offer no buyer or seller protection.

You must have the right to sell what you list, describe it honestly, and comply with local law. You may not list, among other things: weapons or ammunition, illegal drugs or paraphernalia, prescription medicines, alcohol or tobacco, live animals, stolen or counterfeit goods, recalled equipment, hazardous materials, adult services, or anything whose sale is restricted where you are.

13. Ratings and reviews

Members may rate each other after a genuine interaction. Ratings must reflect your own honest experience. You may not buy, sell, trade, or coordinate ratings, rate yourself through another account, or use ratings to threaten or retaliate against someone. We may remove ratings that break these rules.

14. Fees, premium and purchases

NomadHearts is currently free to use. We may introduce optional premium features, in-app purchases, or advertising. If we do:

First Mile members — members who join before launch — receive 3 months of premium free at launch and a First Mile badge on their profile, subject to the terms of that promotion. The badge records when a member joined. It is not a verification of identity, and it implies no relationship with us. Promotional benefits have no cash value and cannot be transferred.

15. App stores

If you download the app from Google Play or the Apple App Store, that store's terms also apply to your download. The store is not a party to these Terms, is not responsible for the app, and has no obligation to provide support or handle claims relating to it. For iOS, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

16. Notifications

We may send you push notifications, emails, and in-app messages about activity on your account, safety matters, and changes to the Service. You can turn off promotional messages in your device or account settings; we may still send you essential service and security messages.

17. Termination

You may stop using the Service at any time and delete your account in the app under Profile → Settings → Account → Delete account. Deleting your account removes your data, including uploaded photos, as described in the Privacy Policy.

We may suspend or terminate your account if you break these Terms or the Community Guidelines, if we are required to by law, or if your conduct risks harm to other members or to us. Sections that by their nature should survive termination will survive it.

18. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that you will find a match, a buyer, a helper, or a travel companion; that the Service will be uninterrupted, secure, or error-free; or that any information provided by members is accurate.

Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you, and nothing here limits rights that cannot be limited by law.

19. Limitation of liability and indemnity

To the fullest extent permitted by law, AWC-DIRECT LLC and its members, officers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising out of your use of the Service or the conduct of any member, whether online or offline.

To the fullest extent permitted by law, our total liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) USD 100.

You agree to indemnify and hold us harmless from claims, damages, and reasonable legal costs arising out of your content, your use of the Service, your breach of these Terms, or your interactions with other members.

20. Dispute resolution

20a. Talk to us first

Most problems can be solved quickly. Before starting formal proceedings, you agree to contact us at info@nomadhearts.online with a short description of the dispute and the resolution you are seeking. We will do the same for any claim we have against you. Both sides agree to try to resolve the dispute informally for 30 days from that notice.

20b. Arbitration

If the dispute is not resolved within 30 days, you and we agree that it will be resolved by binding individual arbitration rather than in court, except as set out below. Arbitration is less formal than a lawsuit, uses a neutral arbitrator instead of a judge or jury, and allows more limited discovery. The arbitrator can award the same individual relief a court could.

20c. What is excluded

Either of us may instead bring an individual claim in small claims court if it qualifies. Either of us may also seek injunctive relief in court to protect intellectual property or to stop unauthorised access to the Service.

20d. No class actions, no jury

Claims may be brought only on an individual basis. You and we waive the right to a jury trial and the right to participate in a class, collective, consolidated, or representative action. If this waiver is found unenforceable for a particular claim, that claim will proceed in court and the rest of this section still applies.

20e. Your right to opt out

You may opt out of arbitration by emailing info@nomadhearts.online with the subject "Arbitration opt-out" and your account email within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms, and we will not hold it against you.

20f. Consumers outside the United States

Nothing in this section removes any right you have under mandatory consumer law in your country of residence, including the right to bring proceedings before the courts of that country.

21. Governing law and venue

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. Where a dispute is not subject to arbitration, it will be brought in the state or federal courts located in Florida, and both sides consent to that jurisdiction — except where mandatory consumer-protection law in your country of residence gives you the right to sue elsewhere.

22. Copyright (DMCA)

If you believe content on NomadHearts infringes your copyright, send a notice to info@nomadhearts.online including: your contact details; a description of the work you say is infringed; where the material is on the Service; a statement that you believe in good faith that the use is not authorised; a statement that the information is accurate and, under penalty of perjury, that you are authorised to act; and your signature. We remove infringing material and terminate the accounts of repeat infringers.

23. Changes to these Terms

We may update these Terms. We will change the "last updated" date above and, for material changes, give notice in the app or by email before they take effect. If you keep using the Service after that, you accept the updated Terms. If you do not agree, please stop using the Service and delete your account.

24. General

These Terms, together with the Privacy Policy and the Community Guidelines, are the entire agreement between you and us about the Service. If any provision is found unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
